If you live in California and you're thinking about a prenup, the first thing to know is that California already has a plan for your money. From the day you say "I do," most of what either of you earns, saves, or builds together belongs equally to both of you. That rule, called community property, kicks in automatically. A prenup is the document that lets you write a different plan together, on purpose, before any of it is theoretical.

California also has the strictest timing rule in the country for getting that document signed. Done well, a California prenup is a calm conversation that finishes months before the wedding. Done late, it can collapse under its own weight. The difference is almost always whether the couple started early enough to honor the rules built into California Family Code.

This guide walks through what those rules actually say, what a California prenup can and can't include, what it costs in 2026, and how to start.

Why is California structurally different from other states?

Most states use what's called equitable distribution, where a judge divides property based on a long list of fairness factors, and "equitable" doesn't always mean "equal." California doesn't work that way. Under California Family Code §760, all property acquired by either spouse during marriage while domiciled in California is presumed to be community property, owned equally by both. The salary you earn next year, the stock that vests during the marriage, the equity in the house you buy together: by default, all of it belongs to both of you, 50/50.

Cal. Fam. Code §770 carves out separate property: what each of you owned before the wedding, plus anything either of you receives during the marriage by gift, devise, or bequest. That sounds clean on paper. In practice, separate and community property tend to mingle quickly once the paychecks start hitting joint accounts and the down payment comes from a pre-marriage savings account topped up with post-marriage income. A prenup is how California couples opt out of that default. It lets you define, in advance, which assets, income streams, and debts will be community property and which will stay separate. In an equitable distribution state, a prenup is a useful planning tool. In California, the default is so consequential that a prenup is the only way to write a different one as you enter your marriage.

On top of the property rules, California layers in the country's strictest procedural protections. That's where the 7-day rule comes in.

California's 7-day rule, explained

Under California Family Code §1615(c)(2)(B), there must be at least seven calendar days between the time one party is first presented with the final version of the prenuptial agreement and the time it is signed. Two details inside that sentence do most of the work.

First, the clock starts at delivery, not at signing. The seven days run from the moment the final agreement is presented to each party, all the way to the day either party signs. If you sit down to sign on June 12, the final agreement must have been in both partners' hands no later than June 4. Second, the rule cannot be waived. In 2020, the legislature closed the loophole that previously let represented parties skip the waiting period. Today, even if both partners have attorneys and everyone is in a rush, the seven days still apply. There is no informed-waiver exception, no judge to ask, no workaround.

Why so strict? The short answer is In re Marriage of Bonds (2000) 24 Cal.4th 1, a California Supreme Court case in which the court enforced a prenup that the disadvantaged party argued had been signed under significant time pressure shortly before the wedding. The legislature responded directly: it amended the Family Code in 2002 to add the independent-counsel requirement for spousal-support waivers, and again in 2020 to expand the seven-day window to all parties regardless of representation.

What this means practically: every California prenup timeline runs backward from the wedding date. If you're getting married on October 10, 2026, your final agreement must be delivered by October 2 at the latest. Most family-law attorneys recommend building in much more cushion than that, because the "final" draft is usually the third or fourth version after negotiation.

What a California prenup can and can't include

California Family Code §1612 sets the scope of what parties can agree to in a premarital agreement. Within that scope, the document is flexible. You can define:

Which property is community and which is separate, including future earnings and appreciation
How debts brought into the marriage and incurred during it will be treated
Each partner's rights to manage and control property during the marriage
What happens to specific assets in the event of divorce, separation, or death
Inheritance and estate-planning coordination, including the right to make a will consistent with the agreement
Choice of law that will govern the agreement itself

There are firm limits. A California prenup cannot determine child custody or child support; those questions belong to the court, decided in the best interests of the child at the time the question arises. It cannot include provisions that violate public policy or that a court would find unconscionable, a legal standard meaning grossly unfair at the time of enforcement.

Spousal support gets its own special treatment. Under §1612(c), a provision regarding spousal support, including a waiver, is not enforceable against a party who was not represented by independent legal counsel at the time the agreement was signed. Even with independent counsel on both sides, a spousal-support provision will still be reviewed for unconscionability at the time enforcement is sought. In re Marriage of Facter (2013) 212 Cal. App.4th 967 is one of the clearest reminders that California courts apply that second look seriously.

What this means in practice: if you want to address spousal support in your California prenup, both partners need their own attorney reviewing the agreement before signing. This is the one area where California explicitly requires independent counsel, and it's also the area where the most California prenups fail at enforcement. A well-drafted spousal-support provision is designed to hold up under both the §1615 procedural rules and the §1612(c) counsel requirement, but no provision can be promised to survive a court's later unconscionability review.

Community property vs. separate property in California

Because community property is the default for almost everything earned or acquired during marriage, most of the substance of a California prenup is about deciding what to opt out of that default. A few common scenarios:

Pre-marriage assets. Anything you owned outright before the wedding is already separate property under §770. The role of the prenup is to keep it that way: by specifying, for example, that the appreciation of a pre-marriage brokerage account stays separate, or that a pre-marriage condo and any rental income from it remain yours alone.

Equity compensation and business interests. This is where California's community property default bites hardest. Stock options, RSUs, and founder equity that vest during the marriage are typically community property by default, even if the grant predates the marriage. A prenup can define how vesting will be treated and which portion, if any, becomes community.

Inheritance and gifts. Gifts and inheritances are separate property under §770, but they lose that status fast if commingled with community funds. Prenups often include explicit language about how inherited assets will be held, titled, and tracked so they retain their separate character.

Debts. California's community property rules also reach debts incurred during the marriage. A prenup can designate certain debts (student loans brought in, business debt taken on by one partner) as that partner's separate responsibility.

A prenup doesn't change California's default rules in the abstract; it changes them for you. The community property presumption still exists. The agreement is what tells a court that the two of you, with full information and time to consider, decided on something different.

How much does California prenup cost?

Lawyers in California cost more than lawyers almost anywhere else, and California prenup pricing reflects that.

The BLS Occupational Outlook Handbook reports that the median annual wage for lawyers in the United States was $151,160 in May 2024, with the top 10 percent earning more than $239,200. California is well above that median. According to the ABA Profile of the Legal Profession, citing BLS Occupational Employment and Wage Statistics for May 2023, three of the top ten U.S. metro areas for average lawyer wages are in California: San Jose-Sunnyvale-Santa Clara at $268,570, San Francisco-Oakland-Hayward at $235,940, and Los Angeles-Long Beach-Anaheim at $219,740.

That translates directly into hourly rates. Family-law attorneys in the major California metros commonly bill between $300 and $800 an hour, and a traditional two-attorney prenup process (one for each partner, with negotiation between them) routinely lands between $2,500 and $10,000+ per person. Complex estates, business interests, or contested terms push the total well above that.

The math is what made flat-fee online prenups possible. When the underlying document is well-built and California-specific, much of the per-hour attorney work in a traditional process is duplication. How to get a California prenup, step by step

The sequence below is the same regardless of whether you go traditional or online. The work happens in the same order; what changes is who's doing it.

1. Have the conversation, early. Before any drafting starts, both partners need to be aligned on the fact that you're doing this together. 2. Gather full financial disclosure. Both partners assemble a complete picture of assets, debts, income, and obligations. California requires fair and reasonable disclosure under §1615, and incomplete disclosure is one of the most common reasons agreements get challenged later. 3. Decide on terms together. What stays separate, what becomes community, how income is handled, how debts are allocated, whether spousal support is being addressed. This is the substance of the agreement, and it's worth talking through before any lawyer or platform starts drafting.

4. Draft the agreement. Either through a family-law attorney, a mediated process, or an online platform built around California's rules. Whatever the path, the draft has to reflect both the substance you've agreed to and the procedural requirements of §1611 (writing, signatures), §1612 (scope), and §1615 (timing, voluntariness, disclosure).

5. Independent review, if required. If your agreement includes any spousal-support provision, both partners must have independent legal counsel review and sign off. Even when not strictly required, independent review strengthens enforceability and is something many California family-law attorneys recommend regardless.

6. Deliver the final agreement, then wait seven days. This is the §1615(c)(2)(B) step. Mark the delivery date in writing for both partners. Then wait the full seven calendar days between the date of delivery and the date of signing.

7. Sign, store, and (optionally) notarize. Both partners sign. While §1611 doesn't require notarization for enforceability, many attorneys recommend it for evidentiary strength, and notarization is required if the prenup will be recorded against real property. Remote online notarization (RON) is acceptable for California residents so long as they use out-of-state notaries, though couples should confirm with their notary or platform regardless whether their specific signing fits within RON.
