At first glance, the answer may seem simple. Many people assume they can choose any state where they have a connection, or even a state that they believe has more favorable laws. In reality, however, the enforceability and effectiveness of a prenuptial agreement often depend on a much more practical question: where do you live, or where do you plan to live during the marriage?

Understanding the role of jurisdiction is essential to ensuring that your prenuptial agreement will hold up if it is ever challenged.

Why Jurisdiction Matters in Prenuptial Agreements

A prenuptial agreement can modify the default rules established by state law, but it cannot override mandatory legal requirements or public policy limitations. In simple terms, what matters most is not where your prenup is signed, but whether a court in the state where you divorce will actually enforce it. Each state has its own rules regarding:

What can and cannot be included in a prenup
How the agreement must be executed
What makes an agreement enforceable
How courts interpret and apply the agreement in the event of divorce

For example, some states follow a community property system, where most assets acquired during the marriage are owned equally by both spouses, while others follow an equitable distribution model, where assets are divided based on what a court considers fair, which may not be equal. These two frameworks can lead to very different outcomes in a divorce, and a prenuptial agreement drafted without the correct system in mind may not address the right issues or provide the protection you expect.

Because of these differences, the state in which your agreement is created, and more importantly, the state whose laws will govern your marriage and potential divorce, plays a critical role in its effectiveness.

Many states have adopted some version of the Uniform Premarital Agreement Act (UPAA) or the updated Uniform Premarital and Marital Agreements Act (UPMAA), which provide a common framework for how prenuptial agreements are created, enforced, and interpreted across state lines. These uniform laws address key issues like voluntariness, financial disclosure, and choice of law. However, each state may adopt or modify these provisions differently, so the specific rules that apply to your agreement will depend on the state whose law governs it.

The Key Principle: Focus on Where You Reside (or Will Reside)

A common guiding principle is that a prenuptial agreement should be drafted with the laws of the state where you currently reside or where you reasonably expect to reside during the marriage.

This is because: Courts typically apply the law of the state where the couple is domiciled at the time of divorce.

In other words, the most relevant jurisdiction is not necessarily where you sign the agreement–it is where your life will be centered if the agreement is ever enforced.

Common Misconceptions About “Choosing” a State

This leads to what lawyers call "forum shopping": the idea that a couple can simply choose whichever state has the most favorable prenuptial agreement laws and effectively anchor their agreement there. Customers with ties to multiple states often assume they can “shop” for a favorable jurisdiction. For example, someone may:

Own property in one state
Work in another
Plan to relocate to a third state after marriage

Choice of law refers to which state's substantive rules govern the agreement. Personal jurisdiction, on the other hand, refers to the authority a court has over the parties themselves, based on factors like where they live, where they were married, or where the divorce is filed. Once the court determines it has personal jurisdiction, it will apply its own procedural rules and may decline to enforce provisions that violate local public policy—such as certain waivers of spousal support. This means that even a carefully crafted choice-of-law clause cannot fully insulate a prenuptial agreement from the laws of the state where the divorce ultimately takes place.

The most resilient approach is to draft a prenup that satisfies the formal requirements of both your designated jurisdiction and the state where you are most likely to reside. This will ensure the highest likelihood that the agreement will be enforced no matter which court ends up reviewing it.

Attempting to anchor a prenup in a state with which neither party has a genuine connection introduces unnecessary risk and may undermine enforceability if the agreement is later challenged.

It is also important to consider state residency requirements for divorce, which determine where a couple is legally permitted to file in the first place. Most states require that at least one spouse reside in the state for a specified period—commonly ranging from a few months to a year—before a court will accept a divorce filing. These requirements effectively limit forum selection, as a couple cannot simply choose any jurisdiction in which to dissolve the marriage. Instead, the available forum will typically be the state where one or both spouses are domiciled at the time of separation, further reinforcing that the law of the parties’ actual residence will govern enforcement of the prenuptial agreement as opposed to a strategically selected jurisdiction.

Multi-State Lives Require Forward Thinking

For individuals with connections to multiple states, the key question becomes: Where do you realistically expect to build your married life?

Factors to consider include:

Where you intend to establish your primary residence
Where your spouse will live
Where your children will attend school if you plan to have them
Where you plan to work long-term
Where you are likely to maintain financial accounts and assets
Where a potential divorce proceeding would most likely occur

Your prenuptial agreement should be aligned with the jurisdiction that will most likely govern your marriage—not just where it is most convenient to sign. This is manageable with the right drafting and advice.

What About Different States for Signing vs. Enforcing?

It is possible for a prenup to be signed in one state and later enforced under the laws of another. This is especially common for couples who relocate after marriage, maintain ties to multiple states, or sign their agreement while temporarily residing somewhere other than their permanent home. This is precisely where careful drafting becomes critical.

A well-drafted agreement should:

Anticipate potential changes in residence
Include choice-of-law provisions identifying which state's laws will govern enforcement of the agreement
Be executed in compliance with formal requirements of the relevant jurisdictions, keeping in mind that different jurisdictions may have differing rules with respect to notarization, witness requirements and waiting periods.
Reflect an understanding of how multiple states might treat its provisions

Even with these considerations, courts will ultimately look to whether the agreement is fair, properly executed, and consistent with public policy in the state where enforcement is sought.

Practical Guidance

While every situation is unique, a few general best practices apply:

Start with where you live now. If you are currently established in a state, that is often the most appropriate jurisdiction for your prenup.
Consider where you plan to live. If relocation is imminent, the agreement should account for that future domicile.
Be consistent with your long-term plans. The agreement should reflect the jurisdiction most likely to govern your marital life.
Work with counsel familiar with relevant state laws. Especially in multi-state scenarios, legal advice should account for how different jurisdictions may treat the agreement.
If relocating, review with local counsel. If you relocate to another country or to a state with significantly different marital property laws from the jurisdiction where your agreement was originally drafted, it is always advisable to consult with local counsel in your new jurisdiction. Laws governing prenuptial agreements, including what can be waived, how agreements must be executed, and what courts will and will not enforce, can vary dramatically across state lines and international borders. Any amendments necessary to bring your agreement into compliance with local law should be identified and executed promptly, and well before any conflict or dispute arises.

The Bottom Line

A prenuptial agreement is not just a contract between two individuals—it is a legal document that must be enforceable under the laws of a specific jurisdiction to be effective.

While it may be tempting to focus on where the agreement can be “best” or most conveniently created, the more important question is: Where will this agreement need to stand up in court?

In most cases, that means the state where you reside or where you intend to reside during the marriage. Planning with that jurisdiction in mind, rather than forum shopping for a more favorable state, is the best way to ensure your prenup serves its intended purpose when it matters most.
